Marketing opportunity or copyright infringement?

toyotaDemonstrating an odd approach to viral marketing, Toyota has decided that fan-created wallpapers are an imminent threat to its corporate well-being. According to a piece on TorrentFreak by Ben Jones, Toyota’s lawyers have contacted Desktopnexus to demand the withdrawal of all wallpapers that feature a Toyota, Scion, or Lexus. The site’s owner, Harry Maugans, told TorrentFreak that when he contacted Toyota to clarify what was and was not permissible, he was told that all images of Toyota vehicles should be removed, even those featuring an image copyrighted by non-Toyota related people (such as the car’s owner or other fan creations). In all probability there are valid and compelling reasons why Toyota’s lawyers are taking this course of action; perhaps they could have conveyed those reasons instead of alienating existing and potential customers.
